Consumer Terms of Service

Effective date: October 6, 2026

FlowMoose, Inc. ("FlowMoose," "we," "us," or "our") provides a platform that lets businesses ("Operators") sell prepaid sessions that you can buy, gift, book, and use at the Operator's facility. These Consumer Terms of Service (the "Terms") govern your use of the FlowMoose mobile apps, flowmoose.com, and related services (together, the "Services") to discover businesses, buy and gift sessions, redeem FlowCodes, book times, and unlock or check in at a facility. How we handle personal information is described in our Privacy Policy.

By creating an account, buying or gifting a session, booking a time, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Please read Section 16 carefully. It requires most disputes to be resolved by binding individual arbitration and waives class actions, and it gives you 30 days to opt out of arbitration.

1. Acceptance and eligibility

You must be at least 18 years old and able to form a binding contract to use the Services or make a purchase. The Services are not directed to children under 13 (see our Privacy Policy). The Services are offered in the United States.

2. Definitions

3. What FlowMoose is — and isn't

FlowMoose provides the technology platform that lets you discover Operators, buy and gift sessions, book times, and use those sessions at a facility. The Operator — not FlowMoose — is the seller and merchant of record for every session you buy or redeem. The Operator sets prices, tax rates, schedules and booking rules, expiration, and refund policies; provides the sessions, facilities, and experiences; and is solely responsible for them.

FlowMoose is not a party to the transaction between you and the Operator, does not own or operate any facility, and does not guarantee any Operator, facility, or session. Your payment is processed through Stripe to the Operator, and the Operator's name generally appears on your statement.

4. Your account and guest use

Account (mobile app). To buy for yourself, redeem FlowCodes, manage bookings, and unlock sessions, you create an account with your email address. FlowMoose is passwordless — you sign in with a one-time code sent to your email. Keep access to your email account secure; you are responsible for activity under your FlowMoose account and should notify us of any unauthorized use.

Deleting your account. You can delete your account in the app; we ask you to sign in again with a fresh one-time code first. Deleting cancels your upcoming bookings — any spot already past its cancellation deadline still spends its session — and does not refund any purchase or return the value of sessions you still hold. Some records are kept after deletion, as described in our Privacy Policy.

Guest use (web). On flowmoose.com you can gift sessions and book times without creating an account. By completing a purchase or a booking, you agree to these Terms. You enter your email address at checkout; FlowMoose stores it and uses it to deliver and manage what you bought. The recipient of a gift redeems the resulting FlowCode in the FlowMoose mobile app. If you later sign in to the app with the same email address, the guest bookings and purchases made under it join your account.

5. Buying, gifting, and FlowCodes

6. Prices, refunds, and expiration

Prices are set by the Operator and shown before you purchase, plus any sales tax the Operator has configured for its location. FlowMoose calculates that tax, shows it to you at checkout, and collects it as part of the Operator's charge; the Operator is responsible for remitting it.

Refunds. All sales are final, except as required by law or as the Operator chooses to provide. As the merchant of record, the Operator is responsible for refunds and cancellations under its own policy. FlowMoose does not decide or fund refunds for an Operator's sales and is not responsible for them.

What a refund or a chargeback does to your sessions. Refunds and card disputes run through Stripe, and FlowMoose records each one. If a purchase is refunded in full, or if you dispute a charge with your card issuer and the dispute is decided in your favor, FlowMoose automatically takes back what that purchase still holds: the sessions from it you have not used are revoked, any bookings holding them are cancelled, and any FlowCode from that purchase that has not been redeemed is voided and can no longer be redeemed — including a gift code already in someone else's hands. Sessions you have already used stay used, and a partial refund revokes nothing. You get the money back, not the money and the sessions.

Complimentary sessions. An Operator can give you sessions at no charge through a complimentary code, which you redeem the same way as a gift code. They are the Operator's to give and to take back: no payment is made, so there is nothing to refund, and the Operator can withdraw a complimentary code at any time. Withdrawing a code you have already redeemed takes back the sessions from it you have not used and cancels any bookings holding them — if a booking is cancelled, FlowMoose emails you on the Operator's behalf — while sessions you have already used stay used. Otherwise complimentary sessions work like purchased ones: they are valid at the same facility, under the same rules, and expire on the same schedule, with the clock starting when the code is issued.

Expiration. For each product the Operator decides how long sessions stay valid — a set number of days, or no expiration at all, in which case they never expire. The clock starts when the purchase is made, not when a gift is redeemed: a gift's expiration date is fixed at purchase, and the recipient sees that date. Expired sessions and expired FlowCodes cannot be used or redeemed, and a return code carries the remaining validity of the sessions behind it. A session released by a cancelled booking gets back the time it spent held, so booking a time never shortens how long a session lasts. Unredeemed value that has expired may be forfeited, except where applicable law — such as gift card or stored-value law — provides otherwise, in which case those rights apply.

If an Operator leaves or closes. If an Operator stops using FlowMoose or closes, its sessions and FlowCodes may become unusable through the Services. The Operator — not FlowMoose — remains responsible for honoring or refunding any outstanding value, and your recourse for the underlying service and any refund is with the Operator.

7. Unlocking sessions and visiting facilities

A facility posts a QR code. You scan it with your phone's own camera, which opens the FlowMoose app and either checks you in to a booking for that time or, for a product the Operator does not schedule, redeems one of your sessions on the spot.

When a session is used. A session is used when you redeem it at a facility for an unscheduled product, when a time you booked ends — whether or not anyone checked you in — or when you cancel a booking after its deadline (Section 8). Scanning to check in to a booking does not spend anything extra: the booking already committed the session.

FlowMoose does not own, operate, or control any facility and is not responsible for the condition, safety, staffing, or operation of any facility, or for the services or experiences an Operator provides. You assume the risks of visiting and using a facility, and you must follow the Operator's rules and instructions. Any claim relating to a facility, an activity, or an injury is between you and the Operator.

8. Bookings

Some products are booked for a time. Booking commits one of your sessions for each spot you take, so a party of several people commits one session per person. You can book with sessions you already hold, or buy the sessions you need as part of booking. While a payment for a booking is being processed, your spot is held; if the payment does not complete, the hold is released and you are not charged.

The Operator's rules. For each of its schedules the Operator sets when booking closes, when check-in opens and closes, and how far ahead of the start you can cancel without losing the session. The cancellation deadline that applies to a booking is fixed when you make it, and it is shown to you before you book.

Changing or cancelling. You can cancel a booking, or move it to another time, up to its cancellation deadline. The same session goes back to you — never a replacement — with the time it spent held added back to its expiration, and you can use it again. A move is subject to the same rules, and the session has to still be valid on the new date. After the deadline, or if you do not show up, the session is used. A booked session is spent when the time ends, whether or not anyone checked in, and there is no refund for a booking you miss.

If the Operator cancels. If an Operator cancels a time you booked, your session comes back the same way — the same session, with the time it spent held — and FlowMoose emails you on the Operator's behalf.

Checking in. Where an Operator checks people in, you scan the facility's QR code (Section 7) or its staff mark you in at the front desk. Marking attendance is optional for the Operator and never changes whether your session is used.

Booking without an account. A booking made on flowmoose.com without an account is tied to the email address you enter, and the manage link in your confirmation email is the key to it: anyone who has that link can view, cancel, or move the booking, so keep it to yourself. If such a booking releases its sessions, they come back as a return FlowCode you can redeem in the app, and if you later sign in to the app with the same email address, those bookings and purchases join your account.

9. Acceptable use

You agree not to:

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk.

10. App license and app-store terms

Subject to these Terms, FlowMoose grants you a limited, personal, non-transferable, non-exclusive, revocable license to use the apps for their intended purpose.

These Terms are between you and FlowMoose, not Apple or Google, and the app-store provider is not responsible for the apps or any support. To the extent of any conflict, the applicable app store's standard end-user license terms also apply. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in an embargoed country and are not on any U.S. government restricted-party list.

11. Privacy

Your information is handled as described in our Privacy Policy. With your permission, the app and website use your device's location when you browse nearby businesses or pick a location. When you add a booking to your calendar, the app writes that event to your device's calendar, and — if you have granted it full calendar access — reads your calendar only to avoid adding the same event twice; your calendar is never sent to FlowMoose. The app does not operate your camera: facility QR codes are scanned with your phone's own camera app. Older versions of the app read the code in-app, which is why a camera permission may still be listed for it; no photos or video are captured, stored, or sent.

Email. FlowMoose sends you service email about what you do here — sign-in codes, booking confirmations and changes, gift deliveries, receipts, and an Operator's cancellations. These are part of the Services and are sent whether or not you have unsubscribed. An Operator whose schedule you have booked may also send you campaigns through FlowMoose, which may carry schedule news and offers; they are sent from a FlowMoose address on that Operator's behalf, and every one carries an unsubscribe link. Unsubscribing applies to your email address across every business on FlowMoose, and reporting a booking email as not yours stops further mail to that address as well.

12. Intellectual property

FlowMoose and its licensors own the Services and the FlowMoose name, logo, and other marks; Operators own their own content. We grant you only the limited license described above, and all other rights are reserved.

13. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. FlowMoose does not warrant that the Services will be uninterrupted, secure, or error-free, or that any Operator, facility, or session will be available, safe, or as described. FlowMoose is not responsible for the acts or omissions of Operators or other third parties (including Stripe and the app stores).

14. Limitation of liability

To the fullest extent permitted by law, FlowMoose will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill. FlowMoose's total liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the total amount you paid through the Services in the 12 months before the event giving rise to the claim, or (b) US $100.

Some jurisdictions do not allow certain limitations or the exclusion of certain damages, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law (including, where applicable, liability for personal injury).

15. Indemnification

You will indemnify and hold harmless FlowMoose and its officers, directors, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms or applicable law, or your infringement of anyone's rights.

16. Governing law, arbitration, and class-action waiver

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration provisions below. Nothing here removes any mandatory consumer-protection rights you have under the laws of your home state that cannot be waived by agreement.

Informal resolution first. Before starting an arbitration, please contact us at legal@flowmoose.com so we can try to resolve the matter; the parties will attempt to resolve any dispute informally for 30 days.

Binding arbitration. If we cannot resolve a dispute informally, you and FlowMoose agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as stated below.

Class-action and jury-trial waiver. Disputes will be brought only in an individual capacity. You and FlowMoose waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court for intellectual-property infringement or misuse of the Services.

30-day opt-out. You may opt out of this arbitration agreement by emailing legal@flowmoose.com within 30 days of first accepting these Terms, stating your name and the email on your account. Opting out does not affect the other parts of these Terms.

17. Changes, suspension, and termination

We may update the Services and these Terms from time to time. For material changes, we will revise the "Effective date" above and provide a more prominent notice. Your continued use of the Services after the changes take effect means you accept the revised Terms.

We may suspend or terminate your access for violations of these Terms or risk to the Services, and you may stop using the Services at any time or delete your account as described in Section 4. Sections that by their nature should survive — including disclaimers, limitations of liability, indemnification, and dispute resolution — survive termination.
